These Terms of Use (“Terms”) govern your use of the RetroWeather application (“App”) published by Pankaj Gaikar (“Service Provider”, “we”, “us”). By downloading or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.
RetroWeather provides weather forecasts, optional widgets, themes, and optional paid features (“RetroWeather Pro”). Forecasts depend on third-party weather data (including Apple Weather / WeatherKit). We strive for accuracy but do not guarantee that forecasts, alerts, or timings will always be correct. The App is not a substitute for official emergency warnings or professional advice.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices you own or control, for personal, non-commercial use. See also our End User License Agreement (EULA).
You agree not to: reverse engineer or extract source code except where law permits; redistribute or resell the App; use the App unlawfully; interfere with servers or networks; or attempt to circumvent purchase or entitlement checks.
The App does not require a user account. You are responsible for securing your device and Apple ID.
RetroWeather Pro unlocks features such as multiple saved cities and push notifications, as described in the App. Pro is offered as:
Product identifiers in the App Store: retroweather.pro.monthly, retroweather.pro.annual, retroweather.pro.lifetime. Prices are displayed in the App before purchase and may vary by region and currency.
Billing. Payment is charged to your Apple ID account. Subscriptions automatically renew unless you turn off auto-renew at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage or cancel subscriptions in Settings → Apple ID → Subscriptions on your device.
Free trials and introductory offers. If offered, trial or promotional pricing terms will be shown at purchase and governed by Apple’s rules.
Refunds. Refund requests are handled by Apple under App Store policies. We do not process App Store refunds directly.
Restore purchases. Use “Restore” in the App to re-sync Pro entitlements on a new device, subject to Apple and RevenueCat availability.
The App uses Apple, RevenueCat, and analytics providers. Your use of those services may be subject to their terms, including Apple Media Services Terms and RevenueCat Terms.
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE PROVIDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS ARISING FROM RELIANCE ON WEATHER DATA, MISSED NOTIFICATIONS, OR DEVICE OR NETWORK FAILURES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR PRO IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR USD $10 IF YOU PAID NOTHING.
We may modify the App or these Terms. Material changes will be posted on this page with an updated effective date. Continued use after changes constitutes acceptance.
We may stop offering the App or these Terms at any time. Upon termination, your license ends and you must stop using and delete the App.
These Terms are governed by the laws of India, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country apply.
