Terms of Use
These Terms of Use (“Terms”) govern your use of the Aarti & Pooja application (“App”) published by Pankaj Gaikar (“Service Provider”, “we”, “us”). By downloading or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.
1. The service
Aarti & Pooja is a free, offline-first companion for Hindu aartis, guided poojas, festival awareness, and optional local reminders. The App is informational and devotional in nature. It is not a temple, priest service, medical device, or emergency service, and is not affiliated with any single religious institution unless explicitly stated.
2. License
Subject to these Terms and Apple’s App Store terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices you own or control, for personal, non-commercial use—unless you have a separate written arrangement with us.
3. Acceptable use
You agree not to: reverse engineer or extract source code except where law permits; redistribute or resell the App; use the App unlawfully; scrape or bulk-export bundled content for competing commercial redistribution; interfere with system services; or misuse the App to harass others.
4. Religious & festival content disclaimer
Festival dates, rankings, and seasonal suggestions are provided for informational convenience. Observance dates can vary by region, panchang tradition, and family custom. Always confirm important dates with a trusted local calendar, temple, or pandit when precision matters. Lyrics and pooja steps are shared for personal worship; traditions differ, and the App does not prescribe a single “correct” ritual.
5. Audio & licenses
Bundled audio is original, public-domain, or properly licensed for inclusion in the App. Do not rip, redistribute, or claim commercial rights over App audio or branding. Attribution and license notes appear in Licenses and may also appear in Settings inside the App.
6. Pricing
The App is offered free of charge, with no ads and no in-app purchases in the current product phase. Apple’s Licensed Application End User License Agreement also applies where required: Standard EULA.
7. Third-party services
The App uses Apple services (App Store, notifications, audio session) and may use Google Firebase Analytics in release builds. Your use of those services is subject to their terms, including the Apple Media Services Terms and Apple Privacy Policy.
8. Intellectual property
The App, design, branding, and software belong to the Service Provider or licensors. Traditional religious texts are not claimed as our exclusive copyright. You retain rights in any personal notes you create on your device.
9. Disclaimer of warranty
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, PERFECT FESTIVAL DATE ACCURACY, OR THAT THE APP REPLACES PERSONAL GUIDANCE FROM QUALIFIED TEACHERS OR FAMILY TRADITION.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE PROVIDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS ARISING FROM RELIANCE ON THE APP, MISSED REMINDERS, DATA LOSS, OR THIRD-PARTY SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM, OR USD $10 IF YOU PAID NOTHING.
11. Changes
We may modify the App or these Terms. Material changes will be posted on this page with an updated effective date. Continued use after changes constitutes acceptance.
12. Termination
We may stop offering the App or these Terms at any time. Upon termination, your license ends and you should stop using and delete the App.
13. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country apply.
