These Terms of Use (“Terms”) govern your use of the Bhagavad Gita application (“App”) published by Pankaj Gaikar (“Service Provider”, “we”, “us”). By downloading or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.
Bhagavad Gita is a calm, offline-first reader for the Bhagavad Gita, with Sanskrit, transliteration, translations, optional commentaries, bookmarks, notes, highlights, search, share cards, widgets, and optional daily reminders. The App is not a temple, counseling service, medical device, or emergency service, and is not affiliated with any single publisher or religious institution unless explicitly stated.
Subject to these Terms and Apple’s App Store terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices you own or control, for personal, non-commercial use—unless you have a separate commercial arrangement with us in writing.
You agree not to: reverse engineer or extract source code except where law permits; redistribute or resell the App; use the App unlawfully; scrape or bulk-export the bundled scripture database for competing commercial redistribution beyond what open licenses already permit; interfere with widgets or system services; or misuse the App to harass others.
The App does not require an account. You are responsible for securing your device and Apple ID. Bookmarks, notes, highlights, and progress remain on your device unless you enable optional iCloud sync or share content through the system share sheet.
The App is currently offered without ads and without in-app purchases. We may introduce optional paid features later; if we do, pricing and terms will be described in the App and this page will be updated. Any future App Store purchases would be billed by Apple under App Store policies.
Where required, Apple’s Licensed Application End User License Agreement also applies: Standard EULA.
The App uses Apple services (App Store, notifications, widgets, share sheet, optional iCloud / CloudKit) and may use Google Firebase Analytics (and Crashlytics) in release builds. Your use of those services is subject to their terms, including the Apple Media Services Terms and Apple Privacy Policy.
The App, design, branding, and software belong to the Service Provider or licensors. Bundled scripture datasets are provided under their respective open licenses (for example Unlicense for gita/gita packaging, and ODbL for certain commentary extracts from DharmicData). Traditional Sanskrit text is not claimed as our exclusive copyright. You retain rights in personal notes you author. Open-license obligations for adapted databases (such as ODbL share-alike for the commentary extract) are described in the App’s Settings.
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, PERFECT TRANSLATION OR COMMENTARY ACCURACY, OR THAT THE APP REPLACES PERSONAL STUDY, GUIDANCE FROM QUALIFIED TEACHERS, OR PROFESSIONAL COUNSEL.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE PROVIDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS ARISING FROM RELIANCE ON THE APP, MISSED REMINDERS, DATA LOSS, OR THIRD-PARTY SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM, OR USD $10 IF YOU PAID NOTHING.
We may modify the App or these Terms. Material changes will be posted on this page with an updated effective date. Continued use after changes constitutes acceptance.
We may stop offering the App or these Terms at any time. Upon termination, your license ends and you should stop using and delete the App.
These Terms are governed by the laws of India, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country apply.
