These Terms of Use (“Terms”) govern your use of the Sobriety Tracker application (“App”) published by Pankaj Gaikar (“Service Provider”, “we”, “us”). By downloading or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.
Sobriety Tracker is a personal recovery tool that helps you count sober days, track multiple habits, celebrate milestones, journal your progress, and access SOS craving support tools (breathing exercise, 10-minute timer, and quick call to a contact you choose). The App is not a medical device, treatment program, therapist, or emergency service.
Not medical advice. The App is for informational and motivational purposes only. It does not provide medical, psychological, or addiction-treatment advice. Always seek qualified professional help for substance use, mental health, or medical emergencies. If you are in crisis, contact local emergency services or a crisis helpline.
Subject to these Terms and Apple’s App Store terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices you own or control, for personal, non-commercial use.
You agree not to: reverse engineer or extract source code except where law permits; redistribute or resell the App; use the App unlawfully; interfere with servers or networks; or use the App in any way that harms others or infringes third-party rights.
The App does not require a separate Sobriety Tracker account. You are responsible for securing your device, Apple ID, and any iCloud backup you enable. You are responsible for the accuracy of dates, journal content, and SOS contact information you enter.
Sobriety Tracker is currently offered free of charge with core features included and no ads. If optional premium features are introduced in the future, pricing and terms will be shown in the App before purchase and processed by Apple. Refund requests for App Store purchases are handled by Apple under App Store policies.
The App uses Apple services including iCloud (CloudKit), HealthKit, notifications, widgets, and the App Store. Your use of those services is subject to Apple’s terms, including the Apple Media Services Terms and Apple Privacy Policy.
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, ACCURATE COUNTER CALCULATIONS FOR EVERY EDGE CASE, OR THAT THE APP WILL MEET YOUR RECOVERY GOALS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE PROVIDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS ARISING FROM RELIANCE ON THE APP, MISSED MILESTONES, DATA LOSS, RELAPSE, OR THIRD-PARTY SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP SHALL NOT EXCEED USD $10.
We may modify the App or these Terms. Material changes will be posted on this page with an updated effective date. Continued use after changes constitutes acceptance.
We may stop offering the App or these Terms at any time. Upon termination, your license ends and you should stop using and delete the App.
These Terms are governed by the laws of India, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country apply.
